Matrimonial Causes Jurisdiction.
I John Felmingham of Spring Bay in the Island of Tasmania Licensed Victualler do make oath and say That I was on the fifth day of March one thousand eight hundred and forty five lawfully married to Sarah Ann Aston Myers at Trinity Parish Church Hobart Town in Tasmania aforesaid.
That I lived and cohabited with the said Sarah Ann Aston Myers otherwise Felmingham up to the year one thousand Eight hundred and fifty two when she left my residence at Hobart Town aforesaid without my knowledge or consent and went away to Launceston on the ninth day of September one thousand eight hundred and fifty two with one William Smallman where she lived and cohabited with the said William Smallman and continued to do so until she left for Port Phillip.
That I have had four children by my said wife one son and three daughters of whom one son alone is living and now resides with me.
That on or about the year one thousand eight hundred and fifty four the said Sarah Ann Flemingham committed adultery with one William Lawrence at Hobart Town and that since that time she has continued to live and cohabit with the said William Lawrence in his house in Hobart Town in another petition and has had four children which she calls by the name of Lawrence and she the said Sarah Ann Aston Felmingham makes herself known by the surname of Lawrence.
That I have no intercourse whatever with the said Sarah Ann Aston Felmingham since the year one thousand Eight hundred and fifty two nor have I in any way endorsed the crime of adultery committed by her.
That no collusion or connivance exists between me and the said Sarah Ann Aston Felmingham or William Lawrence in respect of this suit orany of the proceedings herein.
Sworn at Hobart Town aforesaid this thirteenth day of July one thousand eight hundred and sixty one
