He was tried in Essex 3rd Jan 1837. In Australia, Tasmania (Van Diemens Land) he was assigned to James Lucas, son of Nathaniel Lucas the 'Scarborough' and Olivia Gascoigne the 'Lady Penryhn' both first fleet convicts sent to Norfolk Island as the original settlers. James was married to Elizabeth Murray whose parents were Kennedy Murray and Anne White both convicts, Anne from the second fleet the 'Neptune" and Kennedy from the fourth fleet the 'Pitt.
He married James' daughter Olivia after he had been reported by James for insolence on 11 Nov 1839. The case was dismissed. He received a conditional pardon on 19th Jan 1843. His wife Olivia bore him 5 children, Henry, Mary, Eliza, Richard and James. Only Eliza and James survived him.
His occupation in England had been Ploughman.

After Olivia died Richard left Van Diemen's Land for the goldfields of Victoria at Snake Gully Carngham, Ballarat. Left on the 'Clarence' on 27 Oct 1852 with other members of the Lucas family.
